These terms and conditions govern your enrollment and participation in Fluent Way's English language programs.

Acceptance of Terms

By enrolling in any course, program, or service offered by Fluent Way ("Fluent Way," "we," "us," or "our"), you ("student," "you," or "your") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Fluent Way.

If you do not agree to these terms, you may not enroll in or participate in our programs. Your continued participation in our courses constitutes acceptance of any updates or modifications to these terms.

Important Notice

These terms apply to all students regardless of program type (in-person, online, or hybrid), payment method, or enrollment date. Corporate or sponsored students may have additional terms specified in separate agreements.

Enrollment & Registration

Enrollment Requirements

  • Age Requirement: Students must be 18 years or older at the time of enrollment
  • Identification: Valid government-issued photo identification required for verification
  • English Assessment: Completion of placement test or assessment as required
  • Medical Information: Disclosure of any learning disabilities or medical conditions that may affect participation
  • Visa Status: International students must maintain valid visa status throughout the program

Registration Process

Enrollment is confirmed only upon:

  1. Completion of enrollment application and required documentation
  2. Payment of required fees (tuition, deposits, or payment plan setup)
  3. Acceptance of these Terms and Conditions
  4. Completion of placement assessment (where applicable)
  5. Receipt of enrollment confirmation from Fluent Way

Program Changes

Fluent Way reserves the right to:

  • Modify course schedules, content, or instructors with reasonable notice
  • Cancel courses with insufficient enrollment (minimum 6 students for group classes)
  • Combine or restructure classes to optimize learning outcomes
  • Change course locations or formats (in-person to online) when necessary
Our Commitment

We guarantee that enrolled students will receive the full course content as described, regardless of schedule modifications. If we cancel a course, students will receive a full refund or transfer to an equivalent program.

Payment Terms

Tuition and Fees

All tuition and fees are due according to the payment schedule agreed upon at enrollment:

  • Monthly Payments: Due on the 1st of each month for ongoing programs
  • Full Payment: Due at enrollment (10% discount applies)
  • Payment Plans: Custom schedules available with approved credit
  • Late Fees: $25 fee applies to payments more than 7 days overdue

Accepted Payment Methods

  • Credit cards (Visa, MasterCard, American Express)
  • Debit cards
  • Bank transfers (ACH)
  • PayPal
  • Corporate checks (for sponsored students)
  • Cash payments (in-person only, up to $500)

Price Changes

Fluent Way reserves the right to modify tuition rates for future enrollments. Current students are guaranteed their enrollment rate for the duration of their program, except in cases of:

  • Program extensions beyond the original timeline
  • Voluntary program upgrades or changes
  • Additional services requested by the student

Failed Payments

If payment is not received within 14 days of the due date:

  1. Student access to online platforms may be suspended
  2. Student may be temporarily excluded from classes
  3. Account may be referred to collections after 30 days
  4. Enrollment may be terminated after 45 days
Financial Assistance

We offer payment plans, scholarships, and financial assistance for qualifying students. Contact our student services team if you experience financial difficulties to discuss available options.

Attendance Policy

Attendance Requirements

Regular attendance is essential for academic success. Students are expected to:

  • Attend at least 80% of scheduled classes to maintain enrollment
  • Arrive on time and prepared for each session
  • Notify instructors in advance of planned absences
  • Complete makeup work for missed classes

Excused Absences

The following are considered excused absences with proper documentation:

  • Medical emergencies or serious illness
  • Family emergencies or bereavement
  • Court appearances or legal obligations
  • Religious observances
  • Pre-approved work or academic conflicts

Makeup Classes

For excused absences, students may:

  • Attend equivalent classes in different time slots
  • Access recorded sessions (for online/hybrid programs)
  • Schedule individual makeup sessions (subject to availability)
  • Receive extended program timeline at no additional cost

Excessive Absences

Students with attendance below 80% may face:

  • Academic probation
  • Requirement to repeat portions of the program
  • Ineligibility for certificates
  • Program termination without refund
Attendance Support

We understand that life circumstances may affect attendance. Our student services team works with students to develop attendance improvement plans and provide necessary support to ensure academic success.

Student Conduct

Expected Behavior

All students are expected to maintain professional conduct and contribute to a positive learning environment:

  • Treat instructors, staff, and fellow students with respect
  • Use appropriate language and behavior at all times
  • Participate actively and constructively in class activities
  • Respect diverse backgrounds, cultures, and learning styles
  • Maintain confidentiality of other students' personal information

Prohibited Conduct

The following behaviors may result in disciplinary action or program termination:

  • Harassment, discrimination, or bullying of any kind
  • Disruptive behavior that interferes with the learning environment
  • Cheating, plagiarism, or academic dishonesty
  • Use of inappropriate language or content
  • Violation of technology use policies
  • Substance abuse or attendance under the influence
  • Theft or damage to Fluent Way property

Technology and Device Policy

  • Personal devices should be silenced during classes
  • Recording of classes requires instructor permission
  • Use of translation apps during assessments is prohibited
  • Students are responsible for their own device security
  • Inappropriate internet usage is grounds for dismissal

Disciplinary Procedures

Violations of conduct policies will result in:

  1. First Offense: Verbal warning and documentation
  2. Second Offense: Written warning and behavior plan
  3. Third Offense: Suspension and review meeting
  4. Severe Violations: Immediate termination without refund
Appeal Process

Students have the right to appeal disciplinary decisions within 10 business days. Appeals should be submitted in writing to the Academic Director and will be reviewed by an impartial committee.

Refund Policy

Satisfaction Guarantee

We offer a 7-day satisfaction guarantee for all new enrollments. If you are not satisfied with your program within the first week, you may withdraw and receive a full refund.

Withdrawal Refunds

Students who withdraw after the satisfaction guarantee period are eligible for prorated refunds based on the following schedule:

Emergency Circumstances

Full or partial refunds may be granted outside the standard policy for documented emergency circumstances:

  • Serious medical conditions preventing program completion
  • Family emergencies requiring extended absence
  • Employment relocation outside the Miami area
  • Military deployment or service obligations
  • Immigration status changes requiring program withdrawal

Refund Processing

  • Refund requests must be submitted in writing
  • Processing time: 10-15 business days after approval
  • Refunds issued to original payment method when possible
  • Administrative fee of $50 applies to all refunds (except satisfaction guarantee)

Non-Refundable Items

  • Application and enrollment fees
  • Textbooks and materials (once distributed)
  • Assessment and testing fees
  • Individual coaching sessions (once scheduled)
  • Certificate processing fees

Intellectual Property

Fluent Way Property

All course materials, methodologies, and content are proprietary to Fluent Way and protected by intellectual property laws:

  • Textbooks, workbooks, and educational materials
  • Teaching methodologies and curriculum design
  • Online platform content and software
  • Assessment tools and testing materials
  • Video recordings and audio content
  • Fluent Way trademarks and branding

Student Usage Rights

Students are granted limited rights to use materials for educational purposes during enrollment:

  • Personal use for study and homework completion
  • Sharing with study partners within the same program
  • Reference for continued learning after program completion

Prohibited Uses

Students may not:

  • Reproduce or distribute materials without written permission
  • Use materials for commercial purposes
  • Share materials with non-enrolled individuals
  • Create derivative works based on Fluent Way content
  • Record classes without explicit instructor permission
  • Reverse engineer or copy our teaching methodology

Student Work

Students retain rights to their original work while granting Fluent Way limited rights to:

  • Use student work for assessment and feedback purposes
  • Share exemplary work as teaching examples (with consent)
  • Include testimonials and success stories in marketing (with consent)

Limitation of Liability

Educational Outcomes

While Fluent Way is committed to providing high-quality education, we cannot guarantee specific learning outcomes or results. Success depends on various factors including:

  • Student effort and participation
  • Regular attendance and homework completion
  • Individual learning abilities and background
  • Time and energy devoted to practice outside class

Limitation of Damages

Fluent Way's liability is limited to the amount of tuition paid by the student. We are not liable for:

  • Indirect, consequential, or incidental damages
  • Lost opportunities or earnings
  • Personal injury (except as required by law)
  • Damage to personal property
  • Third-party actions or claims

Force Majeure

Fluent Way is not liable for delays or failures in performance due to circumstances beyond our control, including:

  • Natural disasters, pandemics, or public health emergencies
  • Government actions or regulations
  • Technology failures or internet outages
  • Labor disputes or strikes
  • Facility damage or unavailability

Insurance and Safety

Students are responsible for:

  • Their own health and medical insurance
  • Personal property protection
  • Following safety guidelines and procedures
  • Reporting unsafe conditions or incidents

Termination

Student-Initiated Termination

Students may withdraw from programs at any time by providing written notice. Refunds will be processed according to our refund policy.

Fluent Way-Initiated Termination

Fluent Way may terminate student enrollment for:

  • Violation of conduct policies
  • Non-payment of tuition or fees
  • Excessive absences (below 80% attendance)
  • Failure to meet program requirements
  • Providing false information in application
  • Behavior that threatens safety or disrupts learning

Program Completion

Upon successful completion of a program:

  • Students receive official completion certificates
  • Academic records are permanently maintained
  • Alumni benefits and resources become available
  • Continuing education discounts apply

Post-Termination Obligations

After termination or completion:

  • Students must return all borrowed materials
  • Access to online platforms expires after 30 days
  • Outstanding fees remain due and payable
  • Confidentiality obligations continue

Governing Law

Jurisdiction

These Terms and Conditions are governed by the laws of the State of Florida and the United States of America. Any disputes arising from these terms or your enrollment will be resolved in the courts of Miami-Dade County, Florida.

Dispute Resolution

We encourage resolution of disputes through the following process:

  1. Direct Communication: Contact student services to discuss concerns
  2. Management Review: Escalation to academic director if needed
  3. Mediation: Neutral third-party mediation if mutually agreed
  4. Legal Action: Court proceedings as a last resort

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Modifications

Fluent Way reserves the right to modify these terms at any time. Changes will be posted on our website and communicated to enrolled students. Continued participation constitutes acceptance of modified terms.
